CHARLESTON — A former maintenance engineer and supervisor alleges he was not timely paid after he was involuntarily terminated.
William L. Pauley filed a lawsuit July 15 in Kanawha Circuit Court against Charleston West Virginia Hotel Limited Partnership.
In his complaint, Pauley alleges the hotel failed to pay him within the required time constraints under West Virginia law after it laid him off Jan. 12, 2013. The defendants did not pay Pauley until Jan. 21, 2013, which violates the Wage Payment and Collection Act, according to the complaint.
Pauley says he is not the only one who has not received his wages in a timely manner. In turn, he filed a putative class action complaint against the company.
Pauley seeks an unspecified judgment, plus compensatory damages, pre- and post-judgment interest, attorneys’ fees, costs, injunctive relief and other relief the court deems just.
He is being represented by attorneys Todd S. Bailess and Joy B. Mega of Bailess Law Firm in Charleston and Rodney A. Smith and Jonathan R. Marshall of Bailey and Glasser. The case has been assigned to Circuit Judge Carrie L. Webster.
